General terms and conditions of use of the pet2me.eu portal

1.1. The company WERFFT, spol. s ro, Kotlářská 931/53, Veveří, 602 00 Brno, entered in the Commercial Register kept by the Regional Court in Brno, Section C, Insert 11691, IČO: 494 33 318, DIČ: CZ49433318 - PlatátDD (hereinafter only operator ) is the operator of the Pet2me portal (hereinafter P2M), through which it provides services to pet owners - the possibility to register their pets and data about their pet in an online database to facilitate their discovery in case of loss, as well as services to other entities (veterinarians, veterinarians, kennels, shelters, municipalities, etc. .) in the form of access to the database of animals and their keepers, or promotional services within the catalog of services (collectively referred to as services ).

1.2. The P2M portal is available on the operator 's website www.pet2me.eu (hereinafter referred to as web ).

1.3. These general terms and conditions of use of the P2M portal (hereinafter referred to as conditions ) govern the rights and obligations of the operator and visitors or users of the P2M portal and the website (hereinafter referred to as users ) in connection with the use of the P2M portal and the website.

1.4. When visiting the website and further using the P2M portal, users are obliged to get acquainted with these conditions and unconditionally comply with these conditions. Simultaneously with the registration on the P2M portal, the user directly confirms that he agrees with the business conditions.

1.5. Registration on the P2M portal is free for all pets with an identification number associated with the Pet2me locket or for anyone who has purchased a separate Pet2me locket via the website. Other products or services may be charged by the operator according to the price list published on the website. In such a case, the price list forms an integral part of these conditions.

1.6. During the operation of the P2M portal and the website, personal data may be processed, which is governed by separate rules set out on the website.

2.1. The P2M portal is operated for the benefit of its users and their pets. Users are obliged to always proceed in accordance with legal regulations, honestly and in accordance with good morals in any use of the P2M portal. Users must act ethically and responsibly when using this site so as not to damage the good name or cause any other harm to the operator, other users or any other persons.

2.2. Users are fully responsible for the fact that the data they place on the P2M portal is true, current and accurate, and for the fact that they are entitled to publish it via the P2M portal.

2.3. The operator is not obliged to make any correction, censorship or other modification of data and any other content published on the P2M portal. However, the company is entitled to delete or modify content that contradicts these conditions without prior notice; the Company's authorization also includes temporary or permanent blocking of the user's account.

2.4. The user is not entitled to interfere in any way with the content of the P2M portal (unless he is authorized to edit it in accordance with these conditions) or the technical parameters of the P2M portal or website, to disrupt the performance or operation of the P2M portal or website. This prohibition is not limited to the spread of computer viruses, but also to the transmission of any information that may disrupt data routing, degrade the performance or reliability of the P2M Portal or the Website, including any technical infrastructure of the Operator.

2.5. Activities that interfere with individual activity, privacy or user comfort are prohibited. This prohibition applies, inter alia, to the dissemination of unsolicited advertisements, the dissemination of unwanted messages or information that harass other users, attempts to access other users' IDs or passwords, or attempts to change or delete them.

2.6. Users are prohibited from creating or distributing any false, misleading information through the P2M Portal. Intentionally distorted, harassing or otherwise inappropriate content, including vulgarities, derogatory or unsubstantiated comments, etc.

3.1. For access to the P2M portal (beyond the ordinary visit to the website), user registration is mandatory using a form located on the website. After registration, users are assigned a user account and are allowed to use the P2M portal using their own user interface.

3.2. Users are entitled to register as breeders, veterinarians (veterinary surgeries), kennels, shelters and municipalities, or using another role that the operator allows and which corresponds to the user.

3.3. Users are obliged to secure access to the account with a password and further prevent other people from accessing this account. If the role allows it, users are allowed to allow access to the user account to other persons (eg veterinary staff).

3.4. Upon completion of registration (by confirming the registration via a link sent to the user's email provided during registration), a contractual relationship is concluded between the user and the operator and the operator provides users with a non-exclusive, non-transferable and time-limited license to use the P2M portal in accordance with these terms and conditions.

3.5. After completing the registration, users are allowed to register the animal using a chip number, a medallion ordered from the operator, which contains a unique code, or both. The relevant data can then be loaded on the P2M portal and the registration can be confirmed again (registration via a link sent to the user's email provided during registration).

3.6. Users are entitled to cancel the registration or request the cancellation of the registration at any time, on the P2M portal, through the user interface or using the contact details of the operator specified in these conditions. The same procedure can be chosen in case of cancellation of registration of the animal. By canceling the registration, users lose the possibility of full use of the P2M portal and related services. The cancellation of the registration does not affect the rights and obligations of the operator and users acquired before this moment.

3.7. The operator may, at his discretion, allow the following changes to the registration of users or animals:

  • change of breeder - when changing, the existing user (breeder) passes the information on the registration of the animal to the new user (breeder), who confirms this change to the operator (via a link sent to the user's email);
  • introduction of the animal breeder from the kennel - in case of a change, this kennel will enter a new user (breeder) directly for the animal registered by the kennel and the user will subsequently confirm this change (via a link sent to the user's email); and
  • entering data of municipalities - the user (municipality) has the right to enter information about the animal and the breeder, this change will then be confirmed by the user (via a link sent to the user's email).

Any change depends entirely on the will and capabilities of the operator, who does not bear any responsibility for any damage related to the non-implementation of the change. Unless otherwise stated, the change can be made completely without the assistance of the operator by canceling the registration of the animal and subsequently its new registration. Each number (code) assigned to an animal can be registered only once.

3.8. The user (shelter) is entitled to provide information about the breeder who adopts the animal, provided that the shelter will continue to have access to information about the animal and the breeder who is not entitled to change or cancel such registration. In this case, the shelter has the same user rights as the standard breeder of the animal and the actual breeder of the animal is listed only as the keeper of the animal.

4.1. Users registered as veterinarians (veterinary surgeries), kennels and shelters, or using another role that the operator allows, are entitled to publish information about their activities on the P2M portal, respectively. website (hereinafter referred to as catalog ). The publication takes place automatically by filling in the information in the appropriate form located on the website and by checking the option to publish in the catalog.

4.2. By publishing information in the catalog, the operator provides users with a non-exclusive and non-transferable license to use the catalog to the extent of publication of information and the possibility of their subsequent editing for an indefinite period, in accordance with these conditions.

4.3. Users are entitled to delete or request the deletion of the information contained in the catalog at any time, through the user interface or using the contact details of the operator specified in these conditions. The operator reserves the right to delete or modify the information contained in the catalog, even without giving a reason, especially if the information or actions of users contradict these conditions.

5.1. The information accessible through the P2M Portal is private and limited only to users or other persons who have access to the P2M Portal in accordance with these terms (unless otherwise stated).

5.2. Any access to or change of data in the P2M user account can only be performed with the consent of the user to whom the account belongs. Any information about the change of owner or his death must be provided immediately by the holder / manager of the user account on the P2M portal.

5.3. Each user is obliged to allow veterinarians practicing and registered by the Chamber of Veterinary Surgeons of the Czech Republic access to his data and the data of his animals listed on the P2M portal:

  • during the consultation, when the animal is accompanied by its owner or the owner's representative;
  • for all cases of veterinary emergency; and
  • to facilitate the search for the owner when he is not in the presence of the lost animal.

5.4. In the event that users listed on the P2M portal for an animal with information about a veterinarian (veterinary surgery) or a municipality, they will automatically allow access to this information about themselves and the animal.

5.5. If users allow it, veterinarians can register information about them and the kept animal on the P2M portal, provided that such registration must be confirmed by the user himself in the standard way. Without this confirmation, the registration is not completed.

5.6. The operator reserves the right to terminate access to the P2M portal and to provide any services at its sole discretion in the event of unauthorized use of the P2M portal or the information contained therein.

6.1. The user is responsible for any damage caused by its unauthorized use or interference with the P2M portal or website and all their components, including the source code.

6.2. The operator is not liable for any damage other than directly due to the operator's willful misconduct or omission, including damage caused by using the P2M portal or website, such as data loss, any consequences caused by third party crochet, viruses, service interruptions or other unintended problems. .

6.3. The operator is not responsible for any content placed on the P2M portal to the user, or other persons. The operator is not responsible for the functionality of the P2M portal and the website, nor for the topicality, accuracy and factual accuracy of the information on them.

6.4. The operator reserves the right to partially or completely limit the functionality of the P2M portal and the website without further ado. The company is not liable for any damage that may arise in connection with the shutdown of the P2M portal and the website, regardless of its duration.

6.5. Alternatively, the termination of the operation of the P2M portal and the website for any reason does not affect the rights and obligations until then incurred by the operator and users.

6.6. The primary mission of the operator is to provide users with the highest chance of finding a lost animal equipped with the operator's medallion. However, the operator only acts as a possible intermediary between animal breeders and potential people who have found the lost animal. Under no circumstances can the operator guarantee that a lost animal will be found, just as the operator cannot be held responsible for the consequences of a meeting between the user and the person who found the lost animal and any action on the part of such a person.

7.1. The Operator holds all rights, especially property copyrights according to the relevant legal regulations, to the P2M portal, the website and all their components, including content (except content published directly to the user), graphics, multimedia content, source code, overall concept and idea related to P2M portal and all components of their processing.

7.2. Use of any part of the P2M portal and the website, beyond the permitted use according to these conditions, is possible only with the prior express consent of the operator.

7.3. If users place on the P2M portal any materials that contain information, scenes, goods

7.4. or other values protected by copyright, the right to protection of personality or the right to protection of personal data, in particular photographs with images of persons or materials enabling the identification of individuals, are fully responsible for being authorized and possessing any consent of the persons concerned to such publication.

8.1. These conditions are published in the Czech language and in the English language. If there is a discrepancy between the individual language mutations, the currently effective version of the Czech language takes precedence.

8.2. All contractual relations are governed by Czech law.

8.3. These conditions shall take effect on 19. 2. 2021. The operator reserves the right to change these conditions. The change will take effect at the earliest after its publication on the operator's website, based on the approval of the new version by a specific user when logging in to the user account.

8.4. Users are not entitled to assign any of their rights and obligations arising from these conditions, or the related contractual relationship, to a third party without the prior consent of the operator.

8.5. If permitted by the relevant legal regulations, the Czech Trade Inspection Authority, IČO: 00020869, with its registered office at Štěpánská 567/15, 120 00 Prague 2, whose website is located at www.coi, is competent to resolve out-of-court settlement of consumer disputes for the goods and services offered. cz, with the online dispute resolution platform available at http://ec.europa.eu/consumers/odr.
